Terms of Service
Effective Date: January 1, 2026
1. Description of Service
Victor Evidence provides deterministic semantic admissibility and evidence gating software for AI systems. The Service evaluates user-provided or AI-generated content using computational scoring logic. The Service does not generate answers, determine factual truth, certify regulatory compliance, or provide medical, legal, financial, or professional advice.
2. No Professional Advice & Independent Judgment
Victor Evidence provides computational evaluation signals based on deterministic semantic admissibility methodologies. The Service does not provide medical, legal, financial, regulatory, or compliance advice.
Validation outcomes, including PASS or FAIL determinations, represent algorithmic assessments of semantic grounding and admissibility thresholds only. They do not certify factual correctness, regulatory sufficiency, legal defensibility, or professional compliance.
Users are solely responsible for exercising independent professional judgment, reviewing outputs, and determining whether reliance on evaluated content is appropriate within their specific context.
3. High-Risk Use Restriction
The Service is not designed or intended for use in life-critical, medical diagnostic, surgical, aviation, nuclear, emergency response, or other high-risk environments where failure could result in injury, death, or significant harm. Users assume full responsibility for any such use.
4. Third-Party Systems
Victor Evidence operates independently of third-party AI systems, language models, retrieval engines, databases, hosting providers, or infrastructure services. We do not control or guarantee the accuracy, reliability, availability, or performance of external systems integrated by users. Service availability may depend on third-party hosting infrastructure, cloud providers, and network services beyond our control.
5. User Responsibilities
Users are responsible for lawful use of the Service and for ensuring that submitted data complies with applicable laws and regulations. Users must not submit unlawful, infringing, confidential, regulated, or protected data unless authorized to do so.
6. API Usage & Rate Limits
Victor Evidence may impose rate limits, throttle traffic, suspend accounts, restrict usage, or terminate access for abuse, excessive load, suspicious activity, infrastructure stress, or policy violations without prior notice.
7. Intellectual Property
All algorithms, scoring methodologies, Evidence Gate logic, MUE/DUE systems, platform architecture, documentation, and related materials are proprietary intellectual property. Reverse engineering, decompilation, competitive benchmarking, extraction, duplication, redistribution, or derivative system replication is strictly prohibited.
8. License Grant & Use Restrictions
Subject to payment of applicable fees and compliance with these Terms, Victor Evidence grants the licensee a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Service solely for internal business purposes.
The license permits internal commercial use within the licensee’s organization. Redistribution, resale, sublicensing, white-labeling, offering the Service as a standalone validation product, or incorporating the Service into a competing validation system is strictly prohibited without a separate written agreement executed by Victor Evidence.
The Service may not be used to develop, train, calibrate, or improve a competing validation, scoring, or evidence gating system.
9. Data Responsibility
Users are solely responsible for the legality, integrity, and security of submitted data. Victor Evidence does not warrant protection against unauthorized access, cyber intrusion, data interception, or data loss beyond commercially reasonable safeguards. Victor Evidence does not retain ownership of user-submitted data and processes data transiently for validation purposes unless otherwise agreed in writing.
10. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." VICTOR EVIDENCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY. WE DO NOT GUARANTEE ERROR-FREE OPERATION OR CONTINUOUS AVAILABILITY.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VICTOR EVIDENCE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, REGULATORY PENALTIES, OR THIRD-PARTY CLAIMS. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
Users agree to indemnify, defend, and hold harmless Victor Evidence from any claims, damages, liabilities, fines, regulatory penalties, costs, or legal expenses arising from misuse of the Service, unlawful conduct, data violations, or reliance on outputs.
13. Force Majeure
Victor Evidence shall not be liable for failure or delay resulting from events beyond reasonable control, including infrastructure outages, hosting provider failures, cyberattacks, natural disasters, governmental actions, or labor disputes.
14. Arbitration & Class Action Waiver
Any dispute arising under these Terms shall be resolved through binding arbitration in King County, Washington, under the rules of the American Arbitration Association. Users waive the right to participate in class actions or jury trials.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.
16. Export Compliance
Users agree to comply with applicable export control and sanctions laws and represent that they are not located in restricted jurisdictions.
17. Survival
Provisions relating to intellectual property, limitation of liability, indemnification, dispute resolution, and disclaimers shall survive termination of access.
18. Severability
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede all prior understandings or agreements.
20. Modifications
Victor Evidence reserves the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of revised Terms.
